15.3.7 對(duì)廈航責(zé)任的任何免除和限制適用于廈航的代理人、雇員、代表以及將飛機(jī)提供給廈航使用的任何人及其代理人、雇員和代表。在任何情況下,從廈航和上述代理人、雇員、代表以及其他任何人獲取的賠償總額,不得超過(guò)廈航的責(zé)任限額。
15.3.7 Any exclusion or limitation of liability of Xiamen Airlines applies to the agents, employees and representatives of Xiamen Airlines, and to any person or entity whose aircraft is used by Xiamen Airlines for carriage and any of its agents, employees or representatives performing their respective duties..The aggregate amount of the damages payable by Xiamen Airlines or its agents, employees or representatives and any other person, shall not exceed the amount of the limitation of liability of Xiamen Airlines.
15.3.8 如損害是由于索賠人(包括但不限于旅客本人)的過(guò)錯(cuò)造成或者促成,應(yīng)根據(jù)造成或者促成此種損失的過(guò)錯(cuò)的程度,相應(yīng)免除或者減輕廈航的責(zé)任。
15.3.8 Any liability of Xiamen Airlines for damage will be reduced or exempted in case that the damage was caused or contributed to by the fault of the claimant (including but not limited to the passenger himself or herself) in accordance with the extent of the fault that caused or contributed to such damage.[m13]
15.3.9 以上各項(xiàng),不排除公約或適用法律規(guī)定的承運(yùn)人責(zé)任的任何免除和限制。
15.3.9 The aforesaid paragraphs do not exclude any exemption or limitation of carrier liability specified in the Convention or applicable laws.
16 索賠和訴訟時(shí)限
16TIME LIMITATIONS ON CLAIMS AND LITIGATION
16.1對(duì)于有權(quán)對(duì)托運(yùn)行李的損害提出索賠的人,必須在發(fā)現(xiàn)損害時(shí),或最遲必須在收到行李之日起7日內(nèi),向廈航書(shū)面提出索賠要求。對(duì)于延誤,最遲必須在托運(yùn)行李交付旅客之日起21日內(nèi)書(shū)面提出索賠要求。未在前述期間提出異議的,不得向廈航提出索賠訴訟。
16.1In the event of damage to checked baggage the person who is entitled to make a claim shall file a written claim with Xiamen Airlines forthwith after the discovery thereof and, at the latest, within 7 days from the date of receipt. In the event of delay, the claim shall be made at the latest within 21 days from the date on which the baggage has been placed on the passenger’s disposal. Failure to give such notice of complaint within the time aforesaid, no action may be filed against Xiamen Airlines.
