第十一章監(jiān)督管理 CHAPTER 11 SUPERVISION 第一百二十二條民航管理部門(mén)依據(jù)職責(zé)對(duì)危險(xiǎn)品航空運(yùn)輸活動(dòng)實(shí)施監(jiān)督檢查。 Article 122 Civil aviation administration department conducts the supervisory inspection of the activity of the transport of dangerous goods by air in accordance with its responsibility. 民航地區(qū)管理局應(yīng)當(dāng)定期對(duì)轄區(qū)內(nèi)從事危險(xiǎn)品航空運(yùn)輸活動(dòng)主體進(jìn)行檢查，并將監(jiān)督檢查中發(fā)現(xiàn)的問(wèn)題及時(shí)處理并報(bào)告民航局。 CAAC Regional Administration shall regularly conduct inspection of the main body engaging in the activity of transport of dangerous goods by air under its jurisdiction, timely deal with the problems found from the supervisory inspection and report to CAAC. 第一百二十三條民航管理部門(mén)依法對(duì)與危險(xiǎn)品航空運(yùn)輸活動(dòng)有關(guān)單位進(jìn)行監(jiān)督檢查時(shí)，行使以下職權(quán)： Article 123 When the civil aviation administrative department carrying out the supervisory inspection of the units in connection with the activity of the transport of dangerous goods by air pursuant to laws, the following functions and powers are exercised: （一）進(jìn)入相關(guān)單位的營(yíng)業(yè)場(chǎng)所或者其他有關(guān)場(chǎng)所進(jìn)行檢查；詢(xún)問(wèn)被調(diào)查的經(jīng)營(yíng)人、利害相關(guān)人或者其他有關(guān)單位或者個(gè)人，要求其說(shuō)明有關(guān)情況；查閱、復(fù)印有關(guān)文件、資料。 (1)Carrying out inspection by the access to the business place of the relevant unit or other relevant places; inquiring the operator, persons of common interests or other relevant unit or individual who are investigated, requesting them to explain the relevant situations; consulting and duplicating relevant documents and data; （二）對(duì)檢查中發(fā)現(xiàn)的違法、違規(guī)行為，當(dāng)場(chǎng)予以糾正或者要求限期改正；對(duì)依法應(yīng)當(dāng)給予行政處罰的行為，依照本規(guī)定和其他有關(guān)法律、法規(guī)的規(guī)定做出行政處罰決定。 (2) Correcting on the spot or requesting to correct within the time limit the acts in violation of laws and regulations found during the inspection; for the acts which shall be given the administrative penalty in accordance with the laws, the decision on the administrative penalty is made in accordance with this Regulation and the provisions of other relevant laws and regulations; |
